Louisiana's Bad Faith Insurance Law
Louisiana has strong statutory protections against insurance bad faith. Under La. R.S. 22:1892 and 22:1973, insurers who fail to pay claims within 30 days of receipt of satisfactory proof of loss, or who fail to initiate loss adjustment within specified timeframes, may be liable for penalties of up to 50% of the damages or $5,000 (whichever is greater), plus reasonable attorney's fees. These penalty provisions are meaningful — they can substantially increase the value of a legitimate insurance dispute claim and create real incentive for insurers to pay fair settlements.
Appraisal and Mediation
Most property insurance policies include an appraisal clause that allows either party to demand appraisal when there's a disagreement about the amount of loss. The appraisal process involves independent appraisers selected by each party and a neutral umpire who resolves disputes. This process can be faster and less expensive than litigation and often produces fair results.
