Can an HOA Fine Me?

An HOA in Louisiana can only fine you if: (1) the governing documents expressly grant fining authority; (2) the specific conduct violates a rule clearly stated in the governing documents; and (3) the association follows proper notice and due process procedures — written notice, opportunity to cure, and right to a hearing. An HOA that imposes fines without meeting these requirements is acting outside its authority. Improper fines can be challenged and may be unenforceable.

Three Requirements for a Valid HOA Fine

Authority in the Governing Documents

The declaration or bylaws must expressly grant the association the authority to levy fines. A rule alone cannot create fining authority if the declaration does not authorize it.

A Clear Rule Violation

The specific act must be prohibited by the governing documents. The HOA cannot fine for conduct not addressed in the rules.

Proper Notice and Due Process

Written notice of the violation, opportunity to cure, and a right to a hearing before the board are generally required before a fine can be imposed.
