What Can an HOA Legally Do?

An HOA in Louisiana can enforce covenants, collect assessments, maintain common areas, adopt rules, and place liens for unpaid dues — but only to the extent authorized by the governing documents and Louisiana law. An HOA cannot enforce restrictions that violate the Fair Housing Act, act outside the authority in the declaration, selectively enforce rules, or impose fines without due process. All HOA authority derives from the declaration and the Louisiana Homeowners Association Act.
